Terms Of Service

I. GENERAL

- Commissioning me while being a minor is generally possible, however, any commissions exceeding a pricetag of 100,00€ must be directly authorized by your parents.
- You must own the character(s) you want me to draw unless the commission is a gift for the owner of the character(s), or it's a fanart. (If this is the case, please make sure that I will know about it!)
- I hold the right to refuse any commission at any time without justification.
- I most likely will start working on your commission before payment is done, however I am absolutely able to charge both full or partial payment in advance or during the process.
The artwork in question is not at your disposal until I am paid in full.
I reserve the right to send the artwork only after a complete payment is received.
- Any ill behaviour will not be tolerated and your commission will be immediately canceled if it occurs.
-You are aware that another commissioner may pay Priority Fees and have their order done before yours.
- If I see that you haven't read the Terms of Service, I may cancel your
commission.

What I can draw:
-Animals
-Anthros
-Simple Machinery
OCs
-Fantasy Animals/Hybrids
-Light Gore-Any kind of outdoor/nature scenery for the background.(may cost an extra of 30% of your order)
-Mild/ heavy Gore
-Fanart
-Indoor scenery for the background.
-Difficult Machinery
-Difficult scenery
-Weapons and ArmorsFetishes/ NSFW/ pornographic content will cost an extra of 70% of your order. Nsfw Commissions will also require a proof of age.

What I won’t draw:
-humans
-hateful artwork (Ex: self hate, racism, (romanticization of) mental illness, homophobia…)
-Anything promoting the use/abuse of drugs, cigarettes and alcohol. (May be discussed)

II. PAYMENT

- Payment can be made via PayPal (EUR) or Amazon gift-card.
- You have 24h to send the payment unless agreed otherwise.
- Money sent without my consent will be considered as a donation.
- any payment exceeding the agreed upon amount will be considered a tip unless revoked immediately( explanation fallacy - §119 BGB) .PayPal
-I will not invoice you, unless agreed otherwise.
you will transfer the agreed upon amount upon request,onto the bankaccount which i will send you.
I do not account for any spellingmistakes on your end.

III. PROCESS

-for an optimal experience I might need to know a few details about the artwork you would like to receive.Such details are:
-Reference and/or detailed description* of your character(s)
-The pose and/or expression of your character(s)
-The type of commission you want
-The background description (if any)
-Extras (if any)
- If I accept your commission, I will contact you.- 1. -
I will confirm with you the estimated commission price.
Prices are object to change as the artwork progresses (due to changes within the order or addition of further (not prior mentioned) details).- 2. -
Once the payment is received, I will send you your finished artwork.- 3. -
You may ask for a work-in-progress at any time, but please, do not constantly bug me about your commission process. I may cancel your commission if you put too much pressure on me.
I will send you updates of any progress after each session while working on your commission.- 4. -
Do not spam me because you want me to answer right at the moment. Your commission would be automatically cancelled.- 5. -
I will send work-in-progress during the different stages of the artwork, except if you don't want to have any updates on it (needs to be stated specifically).- 6. -
I usually need a few days to two weeks to finish a commission once I start working on it. I will try to never exceed a year unless an unexpected event occurs.
A refund may be discussed in case such a thing happens.
Failure to reply to such discussions might result in a permanent freeze of the comission unless the discussion is continued. The money in question may be witheld until 3 months after the agreement is settled.- 7. -
Once your commission is done, I will send you the high quality version of your order via discord, you may request a sendspace or email of the image.~~~
_{*drawing your characters from a description only will cost 20% extra. I won't be blamed if I got the character wrong due to a unclear description. It will not be subject to changes due to sudden displease.}

IV. CUSTOMER SATISFACTION

I will do (almost) everything to make my customers happy so I'm willing to make edits during and after the commission process.- 2. -
During and after the commission process, I am willing to do small edits such as marking mistakes.- 3. -
Any great edits such as character and background change will come with an extra charge._{Exchanging a character or background completely will come with a newly calculated price.
Eradicating a character from an artwork comes with a fee of 50% of the original artwork.
changes like the aforementioned can only be done until one year after the original work is finished.}- 4. -
If your reference sheet and/or description was unclear, minor edits will come with a fee (10%).

V. COPYRIGHT/ USAGE POLICY

As the artist I am allowed to use the copyrighted artwork to:
- Promote myself on any place or site.
- Display it anywhere to my liking.
- Post it wherever I want.

If you don't want me to post your commission (private commission), it comes with a 50% fee.

As the commissioner you are allowed to:
- 1. -
Use the copyrighted artwork for personal use only unless agreed otherwise.
- 2. -
Print the art, and claim the right of your character(s), but not the drawing itself.
- 3. -
Use and publish the copyrighted artwork online with proper credit.

The following is considered Copyright infringement:
- 1. -
Reproducing/using the copyrighted artwork commercially*.- 2. -
Using the artwork to train any AI.- 3. -
Taking Credit for the creation of the artwork.- 4. -
Removing watermarks/signatures- 5. -
Altering the artwork without my, the artist's, consent.~~~
_{If you break the copyright agreement in any way, every right you had to the drawing will be retracted. Your infringement would also be shout publicly in a way that other artists will be aware of the situation.
You also won't be able to commission me again.}

*Meaning making money of it in any way.

The Purchase of Commercial rights:
- will cost 300% of the original price.When purchased, you are allowed to:
- Make any sort of merch with the artwork
- Use it in books, covers...
- Change (alter/edit) it to your liking.
- Promote your own brand with the artwork.Credit is still required for usage of the artwork, even if altered or edited.

VI. CANCELING/ REFUNDING POLICY

I have the right to cancel and refund the money for your commission at any time without justification.

What may lead to the cancellation (+ refund) of your commission:- 1. -
Personal reasons (mental health, workplace, family…)- 2. -
You constantly bug me about your commission process.- 3. -
You spam me to get an instantaneous reply from me (Ex: tons of question marks)- 4. -
You are disrespectful and I don't feel comfortable to work with you anymore.- 5. -
Mutual consent of termination.

A canceled commission won't be refunded if:
- 1. -
I discover you commissioned me a drawing with stolen character(s): the commissioned piece may be finished and given to the real owner of the character(s).- 2. -
You are more than totally disrespectful towards me.
You cannot cancel the commission or ask for a refund under any circumstances after I receive the payment unless agreed on. If the money has not been sent yet, you, the commissioner have the right to cancel the commission.

If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to alter and sell the copyrighted artwork to new buyers.

You will forbidden to ever commission me, Kiwi_Jun, ever again.
Your name will be publicly mentioned and posted everywhere I want to for others to watch out for.
I also have every right to file a complaint and I have all the right to the money you have given me.

VII. WAIT LIST

You can find my Working List here. It's an easy way to check how many commissions I have to finish before I start working on yours.

About my Wait List:
- Commissions will always have the priority unless:
I need to work on personal art in a way to take care of myself.
I owe someone an art piece (ex: art trade or prize) since a few weeks.
There's a special event I want to emphasize with an artwork. (Ex: birthday gift)
- If your order doesn't have the "Paid" green tag, it means I didn't receive your payment which means I won't start working on your commission even if you are at the top of the list.

Priority Fees
If you want to skip the whole waiting line, you have to pay a priority fee which is 50% of your order. By paying Priority Fees, your commission will be done in a few days only without exceeding a month.
_{If, for some reason, a month is exceeded, you will receive a discount (goodwill).}Priority Fees may be required if you want your commission to be done within a certain time (deadline).- 1. -
Without a priority fee, your commission will be subject to a privately kept queue.Said queue will be served in a way that supports my personal wellbeing and prevention of burnout.All aforementioned timely limits refer to the beginning of visible progress.
It is my goal to keep my motivation up to uphold both a certain standart and to keep creating the best artwork possible.
